Non-binding arbitration is the same process as Binding Arbitration except that the final decision/ruling made by the arbitrator is not automatically binding. Arbitration is a proceeding wherein an individual or panel of individuals ultimately make the final decision/ruling in the dispute(s). An arbitrator in non-binding arbitration hears from each party during the arbitration proceedings and ultimately makes a ruling. Once the arbitrator issues its ruling, the parties then have limited time to decide whether they want to accept the non-binding arbitrator’s ruling or instead continue to pursue their claim/case in Court. Non-binding arbitrations can be voluntarily agreed to, required by a contract, law, or the Court.
